Booking Conditions for Easter Ellister, Portnahaven, Isle of Islay, Argyll
PA48 7UE

1) General

The contract is between you, the person who is renting Easter Ellister, and the Property Owner's Agent, Miss Mairi Anna .

2) Formation of the contract

Before making a booking, please contact to make sure Easter Ellister is available for the dates required. You must send her a completed booking form and payment of a non-refundable deposit of 20% of the property rental. A binding contract between the person who has signed the Booking Form and The Agent will be made when The Agent issues a confirmation invoice. You are responsible for the payment of the price of the full rental and the compliance of the members of your party with these conditions.

Bookings cannot be accepted from persons under 18 years of age at the time of booking. The Agent reserves the right to refuse a booking without giving a reason.

3) Payment

The balance must be paid no later than 6 weeks before arrival at Ellister. Failure to pay the balance on time will constitute cancellation and cancellation charges will become payable in accordance with the paragraph 6 and paragraph 7 below.

If you book less than 6 weeks before departure the full balance of the rental is payable at the time of booking.

4) The Price

The prices are in Sterling and the rental period is weekly, unless otherwise stated. The property is let fully furnished and equipped. The price includes linen, electricity costs and final cleaning services.

5) Security Deposit

A small security deposit is required to cover the cost of any damage or breakages and the cost of other services. You can provide us with a cheque. The security deposit will be returned to you within two weeks of your departure less any costs.

6) Alterations or Cancellations

In the unlikely event it is necessary to make an alteration or cancel the holiday at Easter Ellister then will inform you as soon as possible, and if requested will try to arrange alternative holiday accommodation of a similar type and standard and in a similar location to Easter Ellister. If the alternative accommodation is not acceptable then will refund in full all monies paid and shall be under no liability.

7) Cancellation by You

Any cancellation by you for whatever reason must be in writing addressed to the Agent at the above address. The effective date of cancellation is the date on which we receive written cancellation.

If you cancel 6 weeks or more before your arrival date you will lose your deposit.

If you cancel within 6 weeks of your arrival date or if the holiday booking is cancelled due to non-payment we are entitled to full holiday cost from you.

8) Descriptions

While all the photographs you see and descriptions you read are
fundamentally correct, we cannot accept responsibility if minor errors or
differences in the photographs / illustrations / text used and the actual
property arise.

The Property Owner and The Agent reserve the right to make modifications to
the property specification that are considered necessary in the light of
operating requirements. In the interest of continued improvements, The
Property Owner and The Agent reserve the right to alter furniture, fittings,
amenities, facilities, or any activities, either advertised or previously available,
without prior notice.

If material changes occur after your booking has been made we will advise
you, if there is time before your departure.

9) Number of People using the Property

Only those persons named on the booking form may use the property without prior arrangement. The number of people staying at the property must not exceed the number of sleeping places indicated in the advertised material, except in the case of infants under two years of ages or written consent from The Agent. The Agent reserves the right to revoke the booking at her sole discretion.

10) Access

The Property Owner, The Agent, or their representative shall be allowed free access to Easter Ellister at any reasonable time during any holiday occupancy for the purposes of inspection and maintenance – should the need arise.

11) Arrival and Departure

Check in is from 3:00 pm on the Saturday of your arrival (unless by prior arrangement with The Agent) and the accommodation must be vacated by 10:00 am on the last day unless otherwise specified by The Agent in writing.
If these times are difficult, please advise when you are booking. If your arrival is delayed please inform The Agent or The Property Owner, so that suitable arrangements can be made for entry to Easter Ellister.

12) Pets

Pets are only allowed with the prior permission of the Agent. As Easter Ellister is a working livestock farm, dogs must be kept on a lead at all times whenever not confined to the premises.

There is a small cost for dogs because of additional final cleaning. This charge is £5 per week per dog. Please note dogs are not allowed upstairs or on the furniture – we have had problems this season with dogs being allowed on beds upstairs and on the sofas. This has led to a significant amount of extra cleaning for staff who are already faced with cleaning a large house in little time, before the next guests arrive. Unfortunately if the house is left in an unacceptable state because of pets then we may have to dock your security deposit to cover the cost of extra cleaning.

13) Your Responsibilities

You must keep the holiday accommodation at Easter Ellister and all furniture, fittings effects, facilities and equipment in the same state of repair and condition as at the commencement of your holiday or stay. You must leave the premises in the same state of cleanliness and general order in which you found it. You are responsible for all damage or loss which occurs to the property or its contents during your occupation and will be responsible for paying appropriate compensation to The Agent in the event of breakages or damage.

14) Complaints

In the unlikely event that you are disappointed with Easter Ellister, you must contact the Property Owner or The Agent who will try to solve the problem. If after that you feel that the problems were not sorted out to your satisfaction please write to The Agent within seven days of your return from your holiday at Easter Ellister. If you vacate the property before the end of your rental period without our authorisation you shall lose any rights to compensation.

15) Liability of The Agent.

The Agent shall not be responsible for the death of or personal injury of you or your or any person named on the booking form or other person at the property unless this results from the proven negligence of The Agent.

The Agent shall not be responsible for any loss, breach or delay beyond her reasonable control, including though, but not limited to, act of God, explosion, flood, tempest, fire or accident, war or threat of war, civil disturbance, acts, restrictions, regulations, by-laws, or measures of any kind on the part of governmental or local authority, strikes, lockouts, or other industrial actions or disputes or adverse weather conditions. In any such case she shall be entitled to treat the contract as discharged.

In the event of such a discharge the liability shall be limited to the return of the sums paid to The Agent in respect of the unused portion of the rental calculated on a pro rata daily basis less an administrative charge of £20.00 to cover the reasonable expenses.

The Agent cannot be held responsible for the breakdown of mechanical equipment, such as pumps, boilers, nor for failure of public utilities such as water, electricity and oil.

16) Cleaning

The property will be cleaned throughout at the beginning of the rental period and you must leave it in a reasonable state of tidiness at the end of the rental period.

17) Behaviour

The person signing the contract is responsible for the correct and decent behaviour of his / her party. Should you and your party not behave in such a manner The Property Owner, The Agent or The Maintenance Manager may at his / her absolute discretion ask you and your party to vacate the property without any refund in the price.

18) Staff

Cleaning staff are included as outlined in paragraph 16. Additional staff could be included for an extra cost. Please give as much notice as possible, but we cannot guarantee success. We accept no responsibility for additional staff or services.

19) Linen

Linen is included in Easter Ellister, but it is advisable to take your own beach towels and cot linen. Linen is normally changed on each Saturday. If you require more frequent changes there will be an extra charge.

20) Photographs

Photographs taken at Easter Ellister cannot be sold for profit without the permission of The Property Owner or The Agent.

21) Social Events

It is the policy of The Agent not to allow social events and other functions (e.g. weddings, receptions, large cocktail parties) on the property without prior agreement with me, The Agent. Permission will be required for any event which is attended by more than twice the number of people the property is advertised as accommodating (including the holiday party itself) . If permission is granted an additional fee may be charged.

22) Security and Valuables

Any valuables left at the property are at your own risk.

23) Problems and Faults

Please note that any problems and faults in the house, even matters concerning light bulb failure, should be reported to The Maintenance Manager within a reasonable period of time - e.g. 24 hours.

24) Rubbish disposal

It is your responsibility to remove rubbish in black bags from the premises. Failure to do so will result in the rubbish being removed by The Maintenance Manager. A charge will be made for this service.

25) Law

All contractual obligations arising out of these booking conditions shall be deemed to come into existence in Boghead, Nr Lesmahagow, South Lanarkshire, Scotland, UK and be subject to Scots Law and the exclusive jurisdiction of the Scottish Courts.
